Terms and Conditions of Sale

Terms:

New accounts and C.O.D. orders must be accompanied by a payment of 1/3 of the amount of the order with balance due at pickup or delivery. There is a $25.00 service charge for any returned check.

Terms of NET 30 days from the date of invoice are available to approved credit customers. Accounts are considered past due after 30 days and are subject to a finance charge of 2% per month (24% per annum) plus the cost of collection, if any. Unless there are extenuating circumstances, past due accounts will automatically revert to C.O.D. status.

Applications for credit and credit agreement forms will be sent promptly upon request. Customers applying for credit should allow 2-4 weeks for processing and approval.

Pickup:

We prefer that customers pick up their plant material. In order to facilitate prompt loading of customer's trucks, we need notice 2 days in advance of your anticipated arrival time at Bremo Trees. It is the responsibility of our customers to provide suitable truck coverings. We will not be responsible for the condition of material that is not picked up within 7 days of notice to the customer that the order is ready.

Delivery:

Delivery is at the expense and risk of the purchaser. We will be glad to arrange for shipment on our own truck or with a local reliable carrier. All delivery charges are due when material is delivered.

Delivery rates are $2.60 per loaded mile when delivered by Bremo Trees. Minimum delivery charge is $150.00.

We use reputable contract carriers and charge our customers the carrier's current rate.

Warranty:

We warrant our plant material to be reasonably free of injurious insects and diseases and true to name. Our grading standards and procedures comply with standards of the American Association of Nurserymen.

Fall Digging Hazards:

We wish to warn customers that it is risky to transplant the following trees in the fall:

Betula varieties, Carpinus varieties, Ilex opaca varieties, Liquidambar styraciflua, Liriodendron tulipifera, Prunus-All stone fruits, Pyrus-All pears, Quercus-All oaks except Q. palustris, Salix-weeping varieties, Zelkova varieties

Claims:

All claims are expected to be reported by telephone by the individual placing the order within 48 hours of receipt of the plant material in question; and a formal claim, in writing, must be presented within 10 days of receipt of such material in order to constitute a valid claim. In any event, customers purchasing plant material on credit must settle outstanding accounts under our terms of NET 30 days from the invoice date even if a claim is pending. Under no circumstances will we be liable for an amount greater than the amount originally received by us for such material.
